2. Description and purpose of the Service
The Timot is a free-to-use community platform where users can send or receive messages, alerts, and feedback based on licence plate numbers.
3. Formation and scope of the contract
3.1. These General Terms and Conditions (GTC) set out the terms of use of Timot. This document enters into force upon publication on the website, and by using the Service the user accepts its contents.
3.2. These GTC are concluded for an indefinite period, and the service provider is entitled to amend them unilaterally. Users are notified of changes by publication on the website. The amended terms become effective after publication.
4. Registration and user account
4.1. Registration is required to use certain features of the Service (for example, receiving alerts, adding vehicles and licence plates).
4.2. The user must keep the password created during registration confidential and is responsible for ensuring that persons accessing the account are entitled to use the Service. The service provider is not liable for damages arising from unauthorised access.
4.3. Users without registration may also send an alert or feedback; however, notifications sent without registration do not reach their destination in all cases; therefore, the service provider recommends registration.
4.4. Creating a user account is possible only above the age of 18. Persons under 18 may use the Service only with the consent of their legal representative.
5. Rules for using the Service
5.1. The user may use the Service only for lawful purposes. It is prohibited to use the Service:
- to send false, offensive, or harassing messages;
- to infringe the personal rights or reputation of third parties;
- to commit or facilitate a criminal offence or misdemeanour;
- in any way that hinders or damages the operation of the Timot system or other users’ devices.
5.2. The user must ensure that, when adding a licence plate, they have the right to dispose over the vehicle or act with the consent of the relevant owner. The service provider is not responsible for the accuracy of licence plates and vehicle data recorded by users.
5.3. The content of notifications and feedback sent through the Service is the responsibility of the sender. The service provider is entitled, but not obliged, to moderate content; in the case of unlawful content or content that violates these GTC, the service provider may suspend or delete the user account.
5.4. There are no official procedures on the platform. Notifications sent by users do not qualify as an official notice, authority notification, or evidence; they have no legal effect, and users act solely at their own responsibility.
5.5. Anonymity: Alerts and feedback are forwarded anonymously by default. The owner of the licence plate does not see the sender’s name or contact details, unless the user chooses to share this information in the message.
5.6. Alert and rating limits: To prevent abuse, the service provider sets daily limits for alerts and ratings. As a registered user, a maximum of 100 alerts or ratings may be sent per day, and a maximum of 3 per licence plate. Without registration, a maximum of 10 alerts or ratings may be sent per day, and a maximum of 1 per licence plate. The user must consider before each notification whether their message is truthful and intended to help; unnecessary or abuse-prone notifications are prohibited.
5.7. Rating deadline: The recipient has the opportunity to rate the notification within 72 hours of receiving the alert. Ratings submitted after this time cannot be accepted for technical reasons. With users’ cooperation, they help maintain the quality of the service and filter out false notifications.
6. Intellectual property
6.1. The name Timot, the logo, the web and mobile application, and all related content (in particular text, images, graphic elements, and source code) are protected by copyright. The service provider reserves all rights thereto. The user may use the Service only for their own purposes and is not entitled to copy, distribute, resell, or modify the Service or its content without the service provider’s written permission.
6.2. Content created by the user (e.g., alerts, feedback) remains the user’s property; however, by publishing the content the user grants the service provider an irrevocable, non-exclusive, and worldwide licence to display, transmit, and—subject to compliance with data protection rules—process the content within the Service.
7. Data protection and newsletters
7.1. The service provider processes users’ personal data in accordance with the privacy notice. The service provider’s data processing principles and the scope of processed data are set out in detail in the Privacy Notice.
7.2. The user may subscribe to the newsletter on their profile page. Newsletter subscription is voluntary and may be cancelled at any time. We provide newsletter sending through MailerSend (Mailersend.com), which acts on behalf of the data controller as an e-mail sending processor.
8. Fees and payment
8.1. Use of Timot is currently free of charge; the service provider does not charge a fee for registration, adding a licence plate, or sending notifications. If, in the future, a subscription or paid service is introduced, the service provider will inform users in advance and will set out the relevant conditions in amended GTC.
9. Disclaimer of liability
9.1. The Timot service is available “as is”. The service provider makes every effort to ensure continuous and error-free operation of the platform; however, it does not guarantee uninterrupted or error-free availability.
9.2. The service provider is not liable for data, alerts, or ratings uploaded by users, their accuracy, or for any direct or indirect damages resulting therefrom. Users use the Service at their own risk.
9.3. The service provider assumes no liability for traffic, parking, or other disputes related to the use of the platform, nor for damages caused by third parties. Notification via Timot does not replace reporting to the authorities or immediate intervention.
10. Termination of the contract
10.1. The user is entitled to delete their account at any time, in which case the service provider deletes personal data within the deadline set out in the privacy notice.
10.2. The service provider is entitled to suspend or terminate the user account with immediate effect if the user breaches these GTC, violates the law, or abuses the Service’s capabilities.
11. Disputes and complaint handling
11.1. The service provider receives user complaints at hello [@] timot [pont] app. The service provider provides a substantive response to complaints within 30 days at the latest.
11.2. The service provider’s activity does not fall under the scope of consumer protection law, as the platform is free of charge and does not provide sales or service contracts. Nevertheless, we strive to settle any disputes amicably.
11.3. If the dispute cannot be settled amicably, the user is entitled to turn to the court competent for their place of residence. The contract is governed by Hungarian law.
12. Final provisions
12.1. These GTC are effective from the date of publication and remain in effect until withdrawn. By using the Service, the user acknowledges and accepts the provisions of the GTC.
